Terms of Service

These terms are an agreement between you and Janky Robotics LLC covering GamifySuccess — the website, the mobile apps, and the API. By creating an account or using the service, you accept them. If you do not accept them, do not use the service.

Our Privacy Policy explains how we handle your data and forms part of this agreement.

You must be at least 13years old to hold an account. If you are under the age of majority where you live, you may only use the service with a parent or guardian’s involvement. By using it, you confirm you meet these requirements.

• Sign-in is handled by our login provider. Keep your credentials secure — you are responsible for activity under your account.
• Give accurate information, and keep it current. One person per account, and do not impersonate anyone.
• Personal API tokens act on your behalf with your full permissions. Treat one like a password, and revoke it in your profile settings if it is exposed.
• Tell us promptly if you believe your account has been compromised.

You agree not to:

• Post content that is unlawful, hateful, harassing, sexually explicit, or that promotes violence or self-harm. We filter for some of this automatically, but the rule applies whether or not the filter catches it.
• Harass, impersonate, or abuse other users, including through friend requests, reactions, or shared posts.
• Break the law, infringe anyone’s intellectual property, or upload someone else’s personal information without their permission.
• Attack or probe the service — no attempts to breach it, no scraping, no circumventing rate limits or authentication, no interfering with other users’ access.
• Use the API to place unreasonable load on the service, or resell access to it.

Your habits, notes, reports, tasks, plans, and everything else you create remain yours. We claim no ownership of them.

You give us permission to store, process, back up, and display your content for the sole purpose of operating the service for you — for example, rendering your dashboard, calculating reports, and showing a post to the friends you shared it with. This permission ends when you delete the content or your account. We do not use your content to train machine learning models, and we do not publish it anywhere you have not chosen.

You are responsible for your content and for having the right to post it.

Friend connections, shared streaks, daily reports, and reactions are opt-in and limited to people you have accepted as friends. There is no public feed.

If someone is abusing the service, report it to us at privacy@gamifysuccess.com. We review reports and may remove content or suspend accounts. You can also remove a friend at any time, which stops the sharing in both directions.

We aim to keep the service running but do not guarantee uninterrupted availability. We may change, add, or remove features, and we may suspend the service for maintenance. If we discontinue the service entirely, we will give you reasonable notice and time to export your data.

We may update these terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use the service after that means you accept the updated terms.

GamifySuccess is currently free. If we introduce paid features, we will tell you the price and terms before you are charged, and the features you use today will not be moved behind a paywall without notice.

You can stop using the service and delete your account at any time from Profile → Account. Deletion is permanent, as described in the Privacy Policy.

We may suspend or terminate an account that breaks these terms, that creates legal risk for us or other users, or that is used to attack the service. Where it is reasonable to do so, we will tell you why. A suspended user can still delete their own account and data.

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that your data will never be lost — keep your own copies of anything you cannot afford to lose.

As stated above, nothing in the service is medical, psychological, legal, or financial advice.

To the maximum extent permitted by law, Janky Robotics LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or 50 US dollars.

Some jurisdictions do not allow these limitations, in which case they apply to you only as far as the law allows. Nothing here limits liability for fraud, death, or personal injury caused by our negligence.

These terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules. If you are a consumer, you keep the protections of the mandatory law of the country you live in, and nothing here removes your right to bring a claim in your local courts where the law gives you that right.

If any provision of these terms is unenforceable, the rest stays in effect.
